Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Wunder IP GmbH i.G. ("WunderIP", "we", "us"). By using our services, you agree to these Terms.
1. Eligibility
Our services are designed for patent professionals and legal practitioners. To use our services:
- You must be at least 18 years old
- You must use a professional email address (public email providers such as Gmail, Yahoo, AOL, etc. are not permitted)
- You must have the authority to bind your organization to these Terms
2. Your Account
You are responsible for maintaining the security of your account credentials. Account sharing is not permitted. We do not provide technical support for issues arising from shared account access.
You must provide accurate and complete information when creating an account and keep this information up to date.
3. Subscription & Payment
After the free trial ends, you will need to subscribe to continue using the services. We will notify you before your trial expires.
4. Acceptable Use
You agree to use our services only for legitimate patent-related professional work. You may not:
- Use the services for any illegal purpose
- Reverse engineer, decompile, or disassemble any part of our software
- Resell, sublicense, or redistribute access to the services
- Scrape, crawl, or use automated tools to extract data
- Share account credentials or allow unauthorized access
- Circumvent any usage limits or access controls
- Use the services in any way that could damage or overburden our infrastructure
Fair Use: We expect normal professional usage patterns. Excessive automated requests or bulk processing beyond typical patent workflow needs may be restricted.
5. Intellectual Property
Your Content
You retain full ownership of all data, documents, and content you upload or create using our services. We claim no intellectual property rights over your content.
AI-Generated Output
All output generated by our AI tools belongs entirely to you. You may use AI-generated content for any commercial purpose without restriction.
Our Software
The WunderIP software, including all code, design, and documentation, remains our exclusive property. You may not copy, modify, or create derivative works of our software.
6. Service Availability
We target 99% uptime for our services. In the event of infrastructure provider outages (e.g., data center issues), we will prioritize restoring service as quickly as possible.
Scheduled maintenance will be announced in advance when possible. We are not liable for interruptions caused by third-party infrastructure providers or circumstances beyond our control.
7. Limitation of Liability
Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or fitness for a particular purpose.
To the maximum extent permitted by law, our total liability for any claims arising from your use of the services is limited to the amount you paid us in subscription fees during the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
8. Termination
By You
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until then.
By Us
We reserve the right to suspend or terminate your access if you violate these Terms or use the services in ways inconsistent with their intended purpose. If we terminate your account for reasons other than a Terms violation, we will refund any prepaid fees for unused service.
After Termination
Upon account deletion, your data is removed from our live systems immediately. Data may persist in encrypted backups for up to 30 days before permanent deletion.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the services after changes become effective constitutes acceptance of the new Terms.
10. Email Communications
By creating an account, you agree that we may contact you via email for:
- Account-related notifications (billing, subscription changes, account security)
- Security alerts and important service updates
- Product updates and new feature announcements for WunderIP services
You may opt out of non-essential communications at any time. However, you cannot opt out of account-related and security notifications as these are necessary for the operation of your account.
11. Governing Law & Disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of laws provisions.
Any disputes arising from these Terms or your use of the services shall be resolved exclusively by the courts of Munich, Germany. Court jurisdiction is determined according to the amount in dispute as provided by German law.
